1. General Informations

All orders placed via the website "L'ALPAGE" are governed by these terms and conditions of sale. These are authentic and they apply at the exclusion of all other conditions or agreements. It defines the rights and obligations of each party.

Each customer acknowledges having read, understood and accepted these general conditions of sale, without any reservation. 

L’ALPAGE reserves the right to modify, at any time, the content and form of these general conditions of sales and to make them accessible on this website.

2. Personal Data

L’ALPAGE undertakes to respect the confidentiality of personal data mentioned by customers when ordering on this website and to treat them within the limits imposed by law.

At the first registration via this website, the customer is entitled to refuse the sending of invitation emails or commercial communication by L'ALPAGE. This possibility remains in effect at any time.

The customer undertakes to inform in a necessary way personal data for the purpose of the smooth running of his order (billing and delivery). He agrees that they are correct and up to date at the time of the order. 

 

3. Entry into force of the contract  

The contract comes into effect from the moment the customer has entered the payment information and that they have validated on the site “L'ALPAGE". The order is thus passed.


4. Orders

The customer places an order via this website and the button "add to cart" he adds the selected product in his shopping cart. He may at any time continue his selection of articles, change his shopping cart or complete his order and pay the selection of products. 

Any order made on this site by the validation of the shopping cart commits the customer to buy the products selected according to these general conditions of sale. 

The customer can not complete or cancel an order once it has been placed. No refund is made to the customer.

L’ALPAGE undertakes to sell the products as presented on this website within the limit of available stock.


5. Confirmation of Order

Once the order is validated and paid, the customer receives order confirmation information by email.

The data recorded by L'ALPAGE constitutes irrefutable proof of the order or the transaction made. All data recorded by the financial system constitutes irrefutable proof of financial transactions.

In the event of a subsequent refusal of the method of payment, ALPAGE reserves the right to refuse or cancel the delivery, at its option, of any order made on this website until the payment is settled.

In addition, the company L'ALPAGE reserves the right to sell the products to other customers able to pay the order if the payment pending is not settled in time (in case of tense stocks).


6.Prices

The prices payable for the products are those displayed on this site on the date of the VAT order included in Switzerland, excluding shipping costs.

Delivery cost are billed in addition to the products ordered. These are visible at the time of the shopping cart summary. They are calculated according to the locality of the customer at the time of the order which will be required obligatorily.

L’ALPAGE reserves the right to modify at any time the prices and other charges mentioned on this site.


7. Product Representation 

L’ALPAGE is committed to matching as best as possible the photographs of the products as represented on this site with those of reality. However, depending on how the product is presented on the Internet, the representation made by the customer of the product may potentially differ from reality.


8. Secured Payment  or Payment on Invoice

All payments are made using the credit card (Visa, Mastercard, Postfinance, American Express).

The order will be considered effective after confirmation of the agreement of the bank payment centers.

In accordance with the regulations in force, and to ensure the security and the confidentiality of their information, L'ALPAGE does not memorize the banking data of its customers. It is thus the customer's responsibility to record and print his payment certificate if he wishes to keep the payment details relating to his order. Credit card data is encrypted to protect the customer.


9.Payment on invoice with Swissbilling

"PAYMENT WITH INVOICE WITHIN 30 DAYS with our Partner swissbilling.
swissbilling SA is a service provider, that allows you to receive your order with an invoice in a simple and secure way.
The Invoice will be sent from swissbilling separately from your order, per email or regular mail, depending on your choice. swissbilling’s services are based on a fix fee and your maximum order for the first purchase is CHF 850.00. The invoice is payable within 30 days. For security matters, shipping address and billing address must be identical. swissbilling keeps the right to have a credit check control done through it’s partner CRIF AG in Zurich (Tel.: 0848 333 222, www.crif.ch)."

 

10.Shipping

Shipping of products ordered via this website is provided by L'ALPAGE.

The delivery costs are calculated at the end of the order according to the shopping cart, the weight, the volume and the tariffs of the carrier in charge of the routing. They are the responsibility of the customer except special promotion specified by the seller himself.

From the order and confirmation of payment, delivery times, indicative, are 2 to 8 working days.

Upon receipt of the goods, the invoice will be available on this site.


11.Verification of the goods and return 

It is the customer's responsibility to check the quantity and condition of the goods as soon as the products have been delivered.

In case of error (damaged or missing product), the customer must announce and inform within seven days the company L'ALPAGE at the address in section 1 of these general conditions of sale. L’ALPAGE will replace the missing or damaged product identically if the error is confirmed by its own services.

The products of the company L'ALPAGE can not be the subject of a return or a refund as soon as they correspond in all points to the order form and that they present no defect that could be put at the expense of the company L'ALPAGE.

The only returns likely to be accepted by the company are those where the products have a production defect. If this is the case, the products must be returned as received in their original packaging together with proof of order to the following address:

12.Guarantee

Without limiting the scope of these General Sales Terms & Conditions, no request whatsoever for delivered products, the non delivery of products or other may not exceed the amount of the purchase price of the products which gave rise to a request for damages and interests. IN NO EVENT SHALL ALPAGE BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (EVEN IF THE BIRTH OF SUCH DAMAGE WAS KNOWN OR COULD HAVE BEEN POSSIBLE BY ALPING) COMING INTO RELATIONSHIP WITH ITS PRODUCTS, THEIR USE, SALE OR PRESENT SITE.


13. Major force

L’ALPAGE will make every effort to fulfill its obligations but will not be held responsible for cases of force majeure or fortuitous events. Thus, any delays or lack of delivery resulting from circumstances beyond his control, particularly in the event of strikes, wars, natural disasters or any other circumstances that prevent the smooth running of the production, transport or delivery of products can not be charged to the seller. In addition to the cases usually adopted by the case law, are explicitly established as force majeure or fortuitous cases the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning; the shutdown of telecommunication networks or difficulties specific to external telecommunication networks to customers.


14. Incomplete validation

SIf one or more stipulations of the present general conditions are recognized for invalid or declared such according to a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations keep all their force and their reach.


15. Applicable

The present general conditions of sale as well as any sales where these find application are subjected to the Swiss right. Any dispute in relation to or arising from these general conditions of sale is governed by Swiss law.

The French version of the general conditions is the one prevailing in case of translation error.
